Terms of Service

These Terms of Service are written to be read, not just accepted. We encourage you to go through them.

1. Introduction and Acceptance of Terms

masked.chat (https://masked.chat) is a privacy-first AI chat platform that lets you interact with leading AI language models — without exposing your personal information to them.

Before anything you type leaves your device, our Privacy Shield automatically detects and replaces common personally identifiable information with anonymous placeholders.

You can also create your own masks for anything the engine misses, and remove masks you do not need.

The AI sees the conversation; it never sees you — as long as you use the Shield well.

These Terms of Service ("Terms") are a binding legal agreement between you and masked.chat ("we," "us," "our"), the operators of the website at https://masked.chat and all associated applications, mobile sites, data files, and services linked to these Terms (together, the "Services").

By accessing or using the Services in any way, you confirm that you have read these Terms and agree to be bound by them.

If you do not agree, please do not use the Services.

If you are accessing or using the Services on behalf of a company or other organization, you are entering into these Terms on that organization's behalf.

You represent that you have the legal authority to do so, and in that case, "you" and "your" refer to that organization throughout these Terms.

One more thing worth noting upfront: your use of the Services is not contingent on us delivering any specific future feature or functionality, regardless of anything we may have said publicly about our roadmap.

If you have a separate written agreement with masked.chat covering specific services, that agreement takes precedence over these Terms for those specific services.

Heads up on arbitration: except for the specific dispute types described in section 21, you and masked.chat agree to resolve disputes through binding individual arbitration — not class actions or class-wide arbitration proceedings.

More detail on how this works is in section 21.

By using, installing, or otherwise accessing the services or any part of them, you agree to these terms.

If you do not accept them, do not use the services.

Some features of the services may have their own supplemental terms or guidelines posted alongside them.

Where those supplemental terms conflict with these terms, the supplemental terms govern for that specific feature.

Everywhere else, these terms apply.

2. Who Can Use masked.chat

You must be at least 16 years old to use the Services.

We do not knowingly offer the Services to anyone under 16, and if we become aware that a user is under 16, we will close that account promptly.

If you are using the Services on behalf of an organization, you also need to have the legal authority to bind that organization to these Terms.

By proceeding, you confirm that you do.

The Services are currently intended for users in Canada and jurisdictions where we lawfully operate.

If you are accessing the Services from a location where doing so would violate local law, you are responsible for ensuring your compliance with applicable laws in your jurisdiction.

3. How Our Privacy Shield Works

This section is unique to masked.chat — most services don't have anything like it, so it's worth reading carefully.

When you type a message, masked.chat uses a combination of rule-based detection and a local on-device AI model to identify personally identifiable information ("PII") in your input — things like your name, email address, phone number, or location.

Before your message is sent anywhere, that PII is replaced with anonymous placeholder tokens (for example, "[PERSON_1]" or "[EMAIL_1]").

This substitution happens entirely on your device. It is called masking.

Our detection engine works as your assistant — it will catch most common PII automatically and flag it for masking.

You can also create your own custom masks for information the engine does not detect, and you can remove masks that were applied automatically if you decide they are not needed.

This flexibility puts you in control of exactly what gets masked and what does not.

That control comes with responsibility. The Privacy Shield is a powerful tool, but the ultimate responsibility for ensuring your messages are appropriately masked before sending rests with you.

If our engine misses something — and no automated detection system catches everything — it is your responsibility to identify it and add a custom mask before sending.

You should review every message before submission, particularly when sharing sensitive or contextual information that may not fit common PII patterns.

The mapping between your real PII and those placeholder tokens is stored locally in an encrypted structure called your Identity Vault.

Only you hold the encryption key. masked.chat does not have access to your key, your vault contents, or your original unmasked messages at any point.

If you create an account, an encrypted copy of your Identity Vault is stored on our servers solely to keep your experience consistent across multiple devices.

Because we do not hold the decryption key, this encrypted copy is unreadable to us.

Cloud sync is turned on by default when you register, but you can disable it at any time from your account settings.

If you disable it, your vault stays local to the device you are using.

One important limitation you should understand: even with diligent use of the Privacy Shield, masked.chat cannot guarantee that your identity will remain completely undetectable to AI models.

Some models may employ behavioral or contextual analysis techniques that could potentially infer information about you from patterns in how you write, the topics you discuss, or other non-PII signals — independent of anything masked.chat does.

The more comprehensively you use the masking vault, the more you reduce this risk.

But we cannot eliminate it entirely, and we do not claim to.

What we can promise is that we have built the strongest practical privacy layer we know how to build, and we give you the tools to use it well.

4. Accounts

You can use masked.chat as a guest without creating an account.

Guest access includes our free tier of service — local PII masking and limited access to AI models — subject to the usage limits described on our pricing page at https://masked.chat/pricing.

Free tier terms, including what is included and any applicable limits, may change from time to time.

An account is required to use cloud vault synchronization across devices and to access paid subscription plans.

When you register, you agree to provide accurate, current, and complete information, and to keep that information up to date.

Your account is personal to you — please do not share it with or transfer it to anyone else.

You are responsible for keeping your login credentials confidential and for everything that happens under your account.

If you suspect unauthorized access to your account, let us know right away at support@masked.chat.

You can close your account at any time through your account settings.

When you do, your personal information and encrypted vault will be permanently deleted from our servers within 30 days of closure.

5. Your Content and Intellectual Property

When you use masked.chat, you may submit prompts, messages, files, and other materials through the Services (collectively, "Your Content").

Because the Privacy Shield masks your personally identifiable information before transmission, masked.chat never receives or stores the unmasked version of Your Content.

Your Content belongs to you. We do not claim ownership of anything you create or submit.

That said, in order to deliver the Services to you, you grant masked.chat a limited, worldwide, royalty-free, non-exclusive license to process and transmit Your Content — in its masked, tokenized form — solely to the extent necessary to operate the Services.

This license ends when you delete Your Content or close your account.

You are solely responsible for Your Content and for ensuring that submitting it does not infringe any third-party rights, violate any applicable law, or breach any obligation you have to others.

You assume all risks associated with Your Content, including any intellectual property or other legal claims that may arise from it.

We do not actively monitor Your Content. That said, we reserve the right to review and remove content, or suspend account access, where we have reason to believe that Your Content or your use of the Services violates these Terms or applicable law — for example, if we learn that content constitutes copyright infringement, contains malware, or is otherwise unlawful.

masked.chat-Supplied Content — including AI-generated responses, interface elements, and documentation — is provided for your use through the Services and remains the property of masked.chat or its licensors.

We do our best to keep it accurate and useful, but we cannot guarantee the accuracy, completeness, or timeliness of AI-generated outputs or other materials made available through the Services.

masked.chat owns all rights, title, and interest in the Services themselves — including the Privacy Shield technology, software, design, and trademarks.

Nothing in these Terms gives you any right to use our brand, logos, or domain names beyond what is expressly permitted here or required by applicable law.

6. Your License to Use the Services and Restrictions

We grant you a personal, non-exclusive, non-transferable, royalty-free license to access and use the Services in the way these Terms allow.

This license is for your own use — it cannot be transferred to anyone else and does not extend beyond what is described here.

There are things we ask you not to do with the Services. Specifically, you agree not to:

  • Copy, modify, reverse engineer, decompile, or attempt to extract source code from any part of the Services, including the local PII detection model or the Privacy Shield
  • Attempt to disable, circumvent, or interfere with any security mechanism in the Services, including the masking layer or the encrypted vault
  • Disrupt or interfere with the Services or the infrastructure that runs them, including servers and connected networks
  • Sublicense, resell, or provide access to the Services to third parties, or use the Services to build a competing product
  • Access the Services in ways designed to avoid usage limits, circumvent billing, or exceed quotas
  • Use any automated tool — bots, scrapers, spiders, or similar — to retrieve, index, or mine content from the Services without our written consent
  • Upload or transmit content that promotes or facilitates violence, illegal activity, harassment, hate, defamation, obscenity, or harm to minors
  • Impersonate any person or organization, or misrepresent your identity or affiliation in any way
  • Distribute malware, viruses, or any software designed to damage, intercept, or compromise systems or data
  • Use the Services in violation of any applicable law, regulation, or statute in Canada or in the jurisdiction from which you are accessing the Services

We reserve the right to suspend or terminate your access to the Services if we determine, acting reasonably, that you have violated any of the above.

7. Feedback

We genuinely want to hear from you — reach out anytime at feedback@masked.chat.

If you share ideas, suggestions, or comments about the Services — whether we ask for them or not — you are giving us permission to use that feedback freely, without any obligation to compensate you or keep it confidential.

We may incorporate your suggestions into the Services or share them with others without restriction.

In return, we want to be clear: your feedback does not create any ownership or licensing claim on our part beyond using it to improve things.

8. Pricing and Subscriptions

masked.chat is available on a free tier up to certain usage limits.

If you need more, paid subscription plans are available. The details of what each plan includes and the current pricing are posted on our pricing page at https://masked.chat/pricing.

We may update pricing and plan details from time to time — the page always reflects what is current.

Paid subscriptions renew automatically at the end of each billing period — monthly or annually, depending on what you selected.

By subscribing, you authorize masked.chat or our payment processor to charge your payment method on file at each renewal.

You can cancel your subscription at any time through your account settings.

Cancellation takes effect at the end of the billing period you have already paid for, so you will continue to have access to paid features until that date.

We do not offer refunds on subscription fees except where Canadian consumer protection law requires us to.

If you believe a charge was made in error, please contact us at billing@masked.chat within 30 days of the charge and we will investigate.

If we increase the price of a plan you are subscribed to, we will give you at least 30 days' advance notice before the new price takes effect.

You will always have the opportunity to cancel before being charged at a higher rate.

9. Beta Services

From time to time we make new features available before they are fully ready — things we are still testing, refining, and learning from.

These are our Beta Services, and they will be clearly labelled as such using terms like "beta," "preview," "alpha," "early access," or similar language.

Beta Services are offered voluntarily and entirely at your own risk.

They may contain bugs, errors, or instabilities that could affect your experience or your data.

By using a Beta Service, you agree that we may follow up with you for feedback, and if a Beta Service is offered under a confidentiality arrangement, you agree not to disclose, share, or publicly discuss it without our written permission.

10. AI Model Providers

masked.chat is not an AI language model. We are a privacy layer and aggregation platform that connects you to AI language models operated by third-party providers.

We do not generate, produce, or control any of the AI responses you receive.

The intelligence behind every response comes entirely from the third-party model you selected.

The specific models available to you are listed within the Services.

When you select a model and send a message, your masked (tokenized) message is transmitted to that provider's servers for processing.

Because masking happens before transmission, the provider receives anonymized content — not your PII.

Each AI model provider operates under its own terms of service and privacy policy, which govern how they handle the content they receive.

masked.chat is not responsible for the outputs, accuracy, appropriateness, reliability, safety, or availability of any third-party AI model or the responses it generates.

The quality and nature of responses you receive are entirely determined by the model you choose and its provider.

By selecting a model through our Services, you acknowledge that your masked messages are processed by that provider under their own policies, and that masked.chat has no control over or responsibility for what those models produce.

11. Third-Party Content and Materials

The Services may provide you with access to external websites, resources, content, or information operated by third parties ("Third-Party Materials").

When you follow a link or access Third-Party Materials through the Services, you are leaving our platform and entering territory we do not control.

You access Third-Party Materials at your own risk. masked.chat is not responsible for the availability, accuracy, or content of any Third-Party Materials, and we make no promises to remove or restrict access to any particular third-party resource.

Any harm, loss, or damage arising from your use of or reliance on Third-Party Materials is your responsibility, not ours.

Links to external sites are provided for convenience only and do not constitute an endorsement of any kind.

12. Third-Party Software

Parts of the Services incorporate software components developed and licensed by third parties ("Third-Party Software").

Where that is the case, your use of those components is subject to the license terms of the respective third-party licensors.

Nothing in these Terms expands or supersedes the rights granted to you under those third-party licenses, nor does anything here restrict rights you already have under them.

13. Privacy

How we handle your personal information is set out in our Privacy Policy at /legal?tab=privacy, which forms part of these Terms.

By using the Services, you agree to the collection and use of your information as described in that Policy.

The short version: because of how the Privacy Shield works, masked.chat does not have access to your unmasked messages or the contents of your Identity Vault.

What we do collect and how we use it is limited and described in detail in the Privacy Policy.

If your use of the Services involves data about other people — for example, if you are using the Services in a professional context and handling information governed by specialized privacy laws — you are responsible for ensuring your own compliance with those laws.

masked.chat is not responsible for your compliance obligations.

14. Copyright — Notice and Notice

masked.chat respects copyright and expects users to do the same.

In accordance with Canada's Copyright Act and the Notice and Notice regime, if we receive a valid notice of alleged copyright infringement involving content transmitted through the Services, we are required to forward that notice to the account holder associated with the allegedly infringing activity.

If you believe that your copyrighted work has been infringed through the Services, please send a written notice to legal@masked.chat that includes the following:

  • A description of the copyrighted work you claim has been infringed
  • Sufficient information to identify the infringing material and its location within the Services
  • Your full name, mailing address, and email address
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf
  • Your electronic or physical signature

We will process valid notices in accordance with our obligations under Canadian law.

15. Modifications to the Services

masked.chat is a product in active development, and the Services will change over time.

We may add, modify, or remove features — including pricing structures, security updates, and functionality — without prior notice.

Any new features that appear in the Services are automatically subject to these Terms unless we say otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we do, the revised version will be posted at /legal?tab=terms with an updated effective date.

It is your responsibility to check in periodically. If you continue using the Services after a revised version takes effect, you are agreeing to the updated Terms.

If you do not agree with a change, please stop using the Services.

17. Termination

You can stop using the Services and close your account at any time through your account settings.

Closing a paid account does not entitle you to a refund of any unused portion of your subscription, except where applicable law requires otherwise.

masked.chat reserves the right to suspend or terminate your access to the Services at any time, for any reason or no reason, with or without notice.

We will not be liable to you or any third party for such a termination.

If your account is terminated for a breach of these Terms, any prepaid fees are forfeited.

You are responsible for exporting any content you want to keep before your account is closed.

If we terminate your account for our own convenience rather than for cause, we will make reasonable efforts to give you time to retrieve your data.

In all cases, your encrypted Identity Vault will be permanently deleted from our servers within 30 days of account closure.

18. Disclaimer of Warranties

We want to be straightforward with you about the limits of what we can promise.

The services are provided "as is" and "as available." masked.chat, its affiliates, subsidiaries, and licensors make no express warranties and disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

IN PARTICULAR, WE DO NOT WARRANT THAT: (A) THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, OR ERROR-FREE; (B) THE PRIVACY SHIELD WILL DETECT AND MASK EVERY PIECE OF PERSONALLY IDENTIFIABLE INFORMATION IN EVERY MESSAGE IN EVERY CIRCUMSTANCE — AUTOMATED DETECTION HAS INHERENT LIMITS, AND IT IS YOUR RESPONSIBILITY TO REVIEW AND SUPPLEMENT MASKING AS NEEDED; (C) YOUR IDENTITY WILL REMAIN COMPLETELY UNDETECTABLE TO THIRD-PARTY AI MODELS, WHICH MAY EMPLOY BEHAVIORAL, STYLISTIC, OR CONTEXTUAL ANALYSIS TECHNIQUES THAT OPERATE INDEPENDENTLY OF PII MASKING; (D) ANY AI MODEL OUTPUT DELIVERED THROUGH THE SERVICES WILL BE ACCURATE, APPROPRIATE, COMPLETE, OR FIT FOR YOUR PARTICULAR PURPOSE; OR (E) THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS.

Nothing in these Terms, including sections 18 and 19, is intended to exclude or limit any warranty or liability that cannot be lawfully excluded or limited under applicable Canadian law.

19. Limitation of Liability

To the fullest extent permitted by applicable law, masked.chat, its affiliates, subsidiaries, officers, employees, and licensors will not be liable to you for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the services or these terms — regardless of the theory of liability and even if we have been advised of the possibility of such damages.

This includes, without limitation, loss of profits, loss of data, loss of goodwill, business interruption, or the cost of procuring substitute services.

These limitations apply whether or not masked.chat had reason to know that such damages were possible.

In no event will masked.chat's total cumulative liability to you for all claims arising from or relating to these terms or the services — whether in contract, tort (including negligence), or otherwise — exceed the greater of: (a) the total amount you actually paid us for the services in the twelve months immediately preceding the claim; or (b) one hundred Canadian dollars (CAD $100.00).

Some provinces and jurisdictions do not permit the exclusion or limitation of certain types of damages, so the above limitations may not apply to you in full, to the extent they are prohibited by applicable law.

20. Indemnification

You agree to defend, indemnify, and hold harmless masked.chat and its affiliates, subsidiaries, officers, directors, employees, agents, licensors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses — including reasonable legal fees — that arise out of or relate to: (a) your use of the Services; (b) Your Content; (c) your breach of these Terms; or (d) your violation of any applicable law or the rights of any third party.

21. Disputes and Governing Law

If you have a concern or dispute with masked.chat, we encourage you to reach out to us first at legal@masked.chat.

Most issues can be resolved quickly and informally, and we are genuinely committed to doing that.

These Terms and any dispute arising from your use of the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.

If informal resolution does not work, any dispute or claim arising out of or in connection with these Terms or the Services — other than applications for injunctive or other equitable relief to protect intellectual property or confidential information, which may be brought in any court of competent jurisdiction — will be resolved by binding arbitration in Toronto, Ontario, administered under the Arbitration Act, 1991 (Ontario), before a single arbitrator.

Where arbitration is not required, the courts of Ontario have exclusive jurisdiction and both parties submit to that jurisdiction.

All dispute resolution proceedings — whether in arbitration or otherwise — must be conducted on an individual basis.

You and masked.chat each waive the right to bring or participate in any class action, consolidated proceeding, or representative action.

You also agree not to bring any claim against masked.chat more than one year after the event giving rise to that claim.

You have 30 days from the date you first accept these Terms to opt out of the binding arbitration requirement.

To opt out, send a written notice to legal@masked.chat that includes your full name and a clear statement of your intent to opt out.

Opting out does not affect any other part of these Terms.

22. Miscellaneous

These Terms, read together with our Privacy Policy at /legal?tab=privacy, represent the complete agreement between you and masked.chat regarding the Services.

They replace any prior discussions, representations, or agreements on the same subject.

If a court or arbitrator finds any provision of these Terms to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the rest of the Terms will continue in full force.

Our failure to enforce any provision of these Terms on any occasion is not a waiver of our right to enforce it on another occasion.

Any waiver must be in writing to be effective, and it applies only to the specific situation described in that writing.

You may not assign your rights or obligations under these Terms without our prior written consent.

masked.chat may assign its rights and obligations freely — including in connection with a merger, acquisition, or sale of assets — and the Terms will bind any successor.

These Terms are written in English. In accordance with the Charter of the French Language (Quebec), users in Quebec may request a French-language version by writing to us at legal@masked.chat and we will provide one.
